Mediation/ Problem Solving
TYPES OF PROGRAMS OFFERED
Mediation - Mediation is a voluntary and confidential way to settle disputes. It involves a facilitator or mediator, who works with the parties to investigate and discuss settlement options.
Traditional/Court - Here, the mediator structures a process to assist the parties in reaching a mutually agreeable resolution. We will ask questions that validate and normalize parties' points of view, search for interests underneath the positions taken by parties, and assist the parties in finding and analyzing options for resolution.
Pre-suit Mediation - This type of mediation occurs outside the courtroom. Pre-suit mediation can save both parties time and money when settling disputes.
Limited Appearance Legal Services (drafting documents and forms for use by the clients) - This is a type of legal representation where we help you with parts of your case. We can help you decide what parts of your case we will complete, and what parts you will do yourself.
Mediation/Arbitration - In med-arb, if the mediation ends in an impasse, or if issues remain unresolved, the process doesn’t end there. At this point, parties can move on to arbitration. The mediator can assume the role of the arbitrator and render a binding decision quickly based on their judgments, either on the case as a whole or on the unresolved issues.
Restorative Justice- is a community approach to justice that focuses on the needs of the victims, the offenders, and the involved community. It seeks to repair the harm caused by harmful behavior by addressing the underlying causes and facilitating reconciliation between the parties involved. Instead of solely punishing offenders, restorative justice processes typically involve dialogue, mediation, and agreement-making aimed at healing relationships and restoring social harmony. This approach often emphasizes accountability, empathy, and community involvement in resolving conflicts and repairing harm.
Arbitration - In this scenario, the arbitrator is in control of the process. They will listen to both parties and decide the outcome.
Customized multi-level processes for larger groups - are you managing mediations or negotiations with multiple parties? We can put together detailed legal processes to ensure negotiations go well and are clear between all involved parties.
Limited scope representation - This is when an attorney provides people representing themselves (without an attorney) with advice, coaching, and legal strategy ideas, and they may also perform some legal tasks. Tasks like preparing pleadings that are ready to be filed with the court. This is a cost-effective way for clients to stay in control of the process while still having the legal guidance they desire to protect themselves legally throughout their dispute resolution journey.
